Another point:  The states started following the federal "tough on crime" statutes in the 1990's, with lots of federal funding support for incarceration of the masses.  Now the feds are pulling funding from the states to support the "war on terror" leaving the states high and dry to figure out what to do about the lack of budget and overwhelming prison populations.

The states are victims of their own greed for federal money and willingness to take federal bribes.
