Please accept this as a formal complaint letter & grievance by Cheryl L. Woods cherylw4@tampabay.rr.com for and on the behalf of my son Brian A. Woods (a juvenile, pretrial detainee, living in solitary confinement at the Brevard County Detention Center in Sharpes, Florida.)

Brian was the young age of 13 when he entered this facility, he is now 15.

Brian is being wrongly accused of trying to kill a correctional officer, when he in fact saved this mans life!

Brian has had five different Attorneys in sixteen months. He was appointed a public defender for one day only and then was appointed a conflict Attorney the day after his indictment. He went for almost a month without an Attorney, actually longer because the conflict Attorney was to busy to deal with us. So with the help of my mother we hired three attorney's who did nothing. So I hired another Attorney who has done nothing. So after sixteen long months, five Attorneys later, Brian still sits, awaiting for justice.

The sixteen months in the county jail (Brown's house) have been the most devastating time of our lives.

Brian has been subjected to cruel and inhumane treatment, he lives in solitary confinement. The correctional officers use obscene and abusive language. They threaten him and inflict bodily harm. The mental abuse is far too serious for any words to describe the intentional infliction of emotional distress. While Brian goes to use the phone, several officers have closed and locked his door and then they will go over and take the phone from him, slam his head into the wall, threatening him, using obscene language and tell him to go to his room, although he is locked out of his room. Oh another 30 day lock down for disobeying staff. That is like putting someone in a round room and telling them to stand in the corner. I have an incident report dated 12/12/00 where as Brian had witnesses against this corrupt officer of the law and still no disciplinary action has been taken. Brian has been beaten, kneed in the groin area and pepper maced and left lying in it for days. Most of the incident reports state that INMATE WOODS has done this and that, they never tell of what really happens.

I have documents to substantiate these claims as well as an ABUSE picture of Brian showing that he is in jail, he does have two black and blue eyes and a black and blue forehead.

We all must realize that CHILDREN LEARN what they LIVE. And unfortunately we have no control over the correctional officers who teach our children to conduct themselves in such a manner. So now that Brian is LIVING what he has LEARNED at the hands of our corrupt system, Brian in retaliation, is using obscene language as a way to get back at the officers. And Brian pays the price!!!!!! SOLITARY CONFINEMENT. Whereas the Adult, corrupt, correctional officers never receive any disciplinary actions. All they receive is a pat on the back and a job well done!!!!!!!!!

We had filed a motion to have Brian moved and on January 10,01 we had a hearing before Judge Stein who heard about my concerns of the abuse and being in fear of my sons life, as well as the letter from my private investigator who stated that he did in fact talk to staff members from the county jail who stated that these allegations were true. He also said that officers were paying other inmates commissary to beat Brian up. Judge Stein just reinstated my contact visits (which were terminated by commander Brown) so that I could keep in touch with my son and document all of these incidents. The very next day, Commander Brown, wrote a letter to the Judge and asked him to reconsider letting me visit my son. Commander Brown made false allegations, telling the Judge that I have encouraged my son to use violence toward staff members. I would never do that, that would be like me signing my child's death warrant!!!!!! At the request of Commander Brown, Judge Stein did rescinded the contact order, without calling a hearing. This is currently under investigation by the Judicial Qualifications Commission. So now I have lost my contact order to see if my son is being harmed. The phones have been blocked from the jail so the other inmates can not call, as they so often do. The block that was placed on the phone from jail to Brian's fathers house has been found and removed by the phone company.

It is sad but true that Brian will never receive a fair trial. They all have their minds made up. The State Attorney, Norman Wolfinger has stated that he wants Brian prosecuted to the fullest extent of the law. My Attorney has only been to visit with Brian one time. That was when he told Brian that if he did not receive the remaining balance of his fees, he would not have an attorney. Mr. Manzo has been paid in full for months now and still has not been capable of defending my son. So Brian sits, being tortured and abused. Is there any justice in this world?

There is so much more to this story that I could sit for months and just keep writing, however I must move onto other matters that need attention in Brian's case.

This letter will serve as my formal complaint letter and grievance to Commander Brown and to Sheriff Williams.

And I would like a response letter from the both of them pertaining to the actions of the correctional officers and the disciplinary action taken.

I would also like for you to take into consideration that Brian is AGAIN in solitary confinement, all because he was talking on the phone and your officer turned it off and told Brian to go to his room, which Brian was locked out of. When Brian rang for the OIC, officer Abby came in and started using obscene language before Brian could even explain what had happened.

I would also like to add that when Attorney Manzo was first hire to take care of this jail situation and you were notified, all of the abuse and lockdowns were terminated for awhile. Until you realized that he charged me five hundred dollars and was in fact not doing anything about it, the abuse started again.

My son also has problems with ingrown toe nails that I have to keep paying your medical bills for because the shoes offered to him through commissary are not sufficient enough. I know that a juvenile female is permitted to have shoes brought in for her. So I do not understand why Brain, who has foot problems is not permitted to have shoes. Could you please offer me an explanation as to why certain ones are allowed privileges and other are not?

I would really like to speak to you about this matter as I have spoken to your secretary, Mrs. Wheeler and she seems to be under the impression by Commander Brown that there is no problem at all. She told me that my son seemed to be a role model inmate.

Right now I am working on doing a press conference in front of the jail next Wednesday at 12.30 p.m.

I am trying to get all of the abuses, lockdowns and their incident reports put together.

I have to work 12 hour shifts for the next four days and will not have much time to do too much.

The good Lord gives me strength and courage to keep going.

I sure hope that your husband does walk out of there soon!! Good luck. You and he will be in my thoughts and prayers.

Mother to Protest Treatment of Juvenile Son at Brevard County Detention Center.

Friends and supporters of Cheryl Woods will join her outside the Brevard County Detention Center at 12:30pm on Wednesday April 25th in Sharpes, FL to Protest mistreatment by guards of her son Brian Woods.

Brian has been held without bail for 17 months while awaiting trial, charged with the attempted murder of a correctional officer during a burglary. Brian who was 13 at the time of his arrest has been involved in 25 separate incidents since his incarceration that generated reports. He has been pepper sprayed then left unwashed for days, badly bruised and repeatedly been placed in lock down. Brian has been diagnosed with A.D.D. and has been denied adequate mental health care.

Cheryl Woods said, "I believe my son may be receiving unfair treatment because the victim in my son's alleged crime is a correctional officer."

In December of 2000 Commander Brown informed Cheryl Woods that she was no longer allowed to have contact visits with her son. When Ms Woods asked for a copy of the rules and regulations concerning visits, this was denied.

On January 10th 2001 with counsel for both parties present Circuit Judge Stein signed an order restoring contact visits. The following day this was rescinded at the request of Commander Brown with no notification to the parties. Commander Brown alleges that Ms Woods encouraged her son to fight back if guards gave him any more problems; Woods denies this and has filed a complaint about the incident with the Judicial Qualifications Commission.

A public records request to Commander Brown filed in February for written rules and regulations regarding visits to the jail have gone un-answered.

Protesters are asking for a full investigation into the treatment of juveniles at the facility, that contact visits be restored to Cheryl Woods and that the administration answers the public records request as required by FL statutes.

LITTLE BRIAN'S STORY
February 20, 2001

To whom it may concern,

I am writing to you today in regards to my son, Little Brian. Brian is a young boy, age was 13 at the time of arrest, now 15. Little Brian has been incarcerated now for 15 months in the Brevard County Detention Center in Sharps Florida. An adult facility.

Prior to his arrest, Little Brian was diagnosed with Attention Deficit Disorder, Seizure Disorder, Major Depressive Disorder, Learning Disorder NOS, and Severe Psychological and Environmental Problems.

Since his incarceration he has also been diagnosed as Mentally Retarded.

With knowledge of these facts, Little Brian is still being charged as an adult. He still remains in secured detention at a no bond status. He receives no medications, no counseling, education, no rehabilitation and he certainly does not receive any medical treatment despite the fact that I have offered to pay for it.

Little Brian (A PRETRIAL DETAINEE) has been subjected to cruel and inhumane treatment as well as unusual punishment, SEVERELY! Little Brian at the present time is in lockdown in a suicide gown, although Forensics states that he is not suicidal.

My visitation has been terminated, as well as my two court ordered contact visits. So I am unable to monitor this situation of ABUSE any longer.

There have been at least 16 incident reports. Little Brian has been subjected to cruel beatings as well as mentally abused by both inmates as well as correctional officers.

My Private Investigator has obtained inside information that inmates have been paid commissary for beating Little Brian and then Brian is the one who gets locked down, sometimes 60 days at a time.

Brian has spent most of his time in solitary confinement. (Little Brian is being accused of trying to shoot a correctional officer.) Little Brian was Indicted on first Degree Murder Charges, without counsel, and no one was even shot!!!!

Brian was the one who was shot at.

The transcript for the Indictment is no where to be found. I have obtained four different (Incompetent Attorneys) who have done nothing but take my money. I am a single, hard working mother who cannot afford to hire proper counsel.

I have managed to obtain a copy of a Judges Order finding the defendant indigent for purpose of cost, where the Judge states that the Attorneys can obtain at reasonable and necessary cost associated with the defendant's defense, relating to duplication of discovery, including copying, medical records, transcripts, documents, photographs and electronic recordings.

For obtaining records, court reporting, Private Investigators fees and so on......I have paid for ALL of the above and provided the Attorneys with copies of all. I have documents as well as a picture of Little Brian with two black eyes and a black and blue forehead.

If anyone would like to see these articles, please let me know.

I also know that my son's Civil and Constitutional rights have been violated. If you have any information as to what steps I should take next to save my son's life, Please let me know. I would appreciate any and all information you can provide me with.

We would also like to ask each and every one of you to remember Little Brian in your prayers. We thank each and every one of you who took time to read about Little Brian.

URGENT UPDATE - February 21,2001 - I was at the court house today reviewing my son's records and was asked by one of Brian's first Attorneys why he had not seen me in court all week. He stated that Brian had been there selecting a Jury. I immediately phoned my Attorney and asked why I was not notified and his Secretary stated that they were getting ready to mail me a letter.
