RE: NO MAN IS ABOVE THE LAW

Dear Mr. Patrick:

I am a 55 year old man and former police officer, with 13 years of service in the State of Alabama, and Sir, I feel it is long past due that the United States Department of Justice step in to the massive amounts of corruption within the State of Alabama, with special focus and attention to the Alabama Department of Corrections.

Presently, criminal convictions are being obtained in the U.S. District Court, in the Southern District of Alabama, on former providers of all the Alabama Prisons' telephone services. The said telephone system being an absolute monopoly. These people have been charged with scams relating to over-charging and money laundering. All of this is conducive to an "on-going" criminal enterprise (R.I.C.O.) as nothing has changed in this telephone scam of over-charging, poor to no service, and actually being held hostage by this criminal enterprise.

The Alabama State Attorney Generals office was fully aware of this on-going criminal enterprise, yet chose to do nothing. It was the U.S. Department of Justice that prosecuted these smaller criminals for money laundering.

The Alabama State Ethics Commission (A.S.E.C.) is fully aware of massive corruption, yet mandates that prisoners like myself do their own investigations, knowing full well this is impossible due to their oppressed circumstances. Should I be allowed access to all records, even from prison, I could make a case against many, of the aforementioned criminal enterprise. Yet, the State Ethics Commission is unable? Exactly what are their duties then?

The Alabama Public Service Commission (A.P.S.C.) has received complaint after complaint after complaint. Yet, they do nothing. It appears that even the Alabama Public Service Commission is acting in concert with the other State agencies in this "on-going" criminal enterprise (R.I.C.O.).

Even the Federal Communications Commission (F.C.C.) has received complaints and they claim that it's a local problem, referring us to the Alabama Public Service Commission, sending the fox to watch the hen house.

Fact is, most all these calls are routed across state lines. This not only gives the F.C.C. the jurisdiction to act, but imposes an affirmative duty to act. Yet F.C.C. chooses to ignore their duties, and send the fox to watch the hen house (A.P.S.C.)

Under the Alabama Constitution, the State or its agents are forbidden to compete with private enterprise or form a State monopoly. State law requires closed bids for goods and services, and the lower of these bids to be accepted. Yet neither is the case in Alabama. They ignore their very own laws and Constitution - the "only" methods to protect its residents against absolute tyrants and criminals at the highest of levels in developing an "on-going" criminal enterprise - in direct violation of the R.I.C.O. Act - thus, commanding Federal jurisdiction for relief of such oppressions.

I choose this very day to write, the observance of the Birth of a Nation, where "no" man is above the law, where the birth of freedom applies to all, where we observe our inalienable rights bestowed upon us by the Creator - one of which is freedom from oppression and persecution. Yet in defiance - even in the face of the Creator - the Alabama State Government not only is allowed to oppress and persecute openly, but is also allowed to engage in a massive "on-going" criminal enterprise under the guise of State's Rights.

Sir, I say no state - no man - no groups of men have a right to oppress, persecute and "openly" steal and rob from the public funds.

It has absolutely no rights to hold its residents hostage by what taxes they illegally choose to impose - such as their "on-going" criminal enterprises of their monopolized telephone system. For this is not taxing, it is grand theft on a major-major scale, and few could deny it's in direct violation of the R.I.C.O. Act. I must humbly convey to you that the United States Department of Justice no only has the Right (jurisdiction), it has an absolute "Duty" to protect its citizens, for we may be residents of this Gestapo State, but we are all citizens of the United States of America.

So, with all due respect, I shall ask, If the U.S. Department of Justice has a "Duty" to the citizens of these States United as one - and immediately act to protect all the citizens of the U.S. or will your department choose the easy way out - choose to ignore such a massive corruption of local government and let an "on-going" criminal enterprise flourish? Respectfully, I state: No Man is above the Law.
